2. The service

PromotionPundits provides software for marketing analytics, creative generation, campaign building, prediction, experimentation, and budget automation. Features may change over time as we improve the product.

3. Accounts

You are responsible for safeguarding your login credentials and for all activity under your account. Notify us promptly of any unauthorized use.

4. Billing

  • Paid plans are billed in advance on a monthly or yearly basis per workspace.
  • Fees are non-refundable except where required by law.
  • We may change pricing with reasonable notice before your next billing cycle.

5. Acceptable use

  • Do not use the service for unlawful, deceptive, or infringing activity.
  • Do not attempt to disrupt, reverse engineer, or gain unauthorized access to the platform.
  • Comply with the policies of any advertising platform you connect.

6. AI & automation

The platform generates recommendations, creative, and automated actions. You remain responsible for reviewing outputs and for the spend boundaries, approval modes, and guardrails you configure. AI predictions are estimates and not guarantees of performance.

7. Intellectual property

We own the platform and its underlying technology. You own your data and the assets you create using the service, subject to the licenses needed for us to operate it on your behalf.

8. Liability

To the maximum extent permitted by law, the service is provided "as is," and we are not liable for indirect or consequential damages, including lost ad spend or revenue arising from automated decisions you authorize.

9. Termination

You may cancel at any time. We may suspend or terminate access for violations of these Terms. On termination, your right to use the service ends, and you may request export or deletion of your data.
